These Fatwas are where difficulties in interpretation of Islamic law begin since so many Muftis provide differentiating opinions on abortion. Islamic countries today hold different laws regarding abortions and where their use is applicable. Only Turkey and Tunisia allow abortions in the case of rape, financial difficulties or upon the request of the child’s parents. Other countries such as Afghanistan, Algeria, Iran, Egypt, Jordan, Morocco, Oman, Pakistan, Saudi Arabia, Syria and Yemen only allow it in cases of health benefits to the mother. While in Kuwait and Qatar additional legislation exists to permit it in cases of fetus deformity (Asman, 2004).
If we look at the statistical data, it can be seen that in the Gulf countries, the majority of nations making up 55% of the total will only allow abortions to save a woman’s life. Tunisia and Turkey make up 21% of the total as countries which allow abortions freely within the boundaries of reason. The remaining 24% only allow it in cases where the woman’s physical and mental health must be preserved (Dabash & Roudi-Fahimi, 2008).
