Background checks are supposed to be used by employers to find out information on potential employees that is not included in the employees’ resumes or application forms. This process of finding out information about prospective employees is necessary from the perspective of the employer to protect himself from any complication that may arise in the future. However, there have been too many instances where employers have exploited the rights of job seekers by delving into secret modes of information search that are the private information of the candidates without prior consent from the candidate. Furthermore, there have been cases where employers have abused the privilege of background checks to discriminate against either disabled people or ethnic minorities (Employee Issues, 2008).
Recently there was a famous victory for NASA employees when a federal judge issued an injunction which prohibited NASA from performing background checks on their contracted employees (Rosenberg, 2008). This case can be used as a precedent to prevent background checks in future.
