Discretionary powers are powers which are exercised by administrative and legal authorities (Gonzalez, 2011). To have these powers usually means that one has got the authority and the ability to go ahead and perform a certain act, but one “chooses” not to take any action.
Any institution or administrative and legal authorities which have got these powers are very permissive but not bound to the powers. The statute is responsible for the granting of these powers to the various individuals or organization bodies. The powers do not in any way impose an obligation on a decision-maker to take action. They do not also dictate the manner in which the individual should exercise the powers if he so chooses to.
